Terms of Service

1. Acceptance of these Terms

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. Contacting us by phone, text, email, or through a form on the Site does not, by itself, create a contract for training services; those services begin only under a separate service agreement as described in Section 3.

2. Information on the Site

The Site provides general information about our business, our training approach, and the programs we offer. It is provided for informational purposes and may change without notice. Descriptions of programs, examples, and results shared on the Site are illustrative and do not constitute an offer or a promise about any particular dog.

3. Training services and separate service agreements

Our training programs, including private lessons, board-and-train programs, and related services, may require a separate written service agreement that sets out the program details, pricing, scheduling, cancellation and refund terms, and the rights and responsibilities of both parties.

Training services are subject to a separate written service agreement, and if there is any conflict between these website Terms and a signed service agreement, the signed service agreement controls with respect to the training services covered by that agreement.

4. No guaranteed outcomes

Dogs are living animals, and behavior varies with the individual dog, its history, its health, and the consistency of its handling. Nothing on the Site guarantees a particular training outcome. Any statements about results, guarantees, or the absence of guarantees for a specific program are set out in the applicable service agreement.

5. Pricing and estimates

Any prices, ranges, examples, or program descriptions shown on the Site are subject to change and are not binding offers. The price and terms of a training program are determined by the proposal or service agreement provided to you for that program.

6. Scheduling and availability

Information on the Site about availability, service areas, or scheduling is general. An appointment, evaluation, or program start date is not confirmed until we confirm it with you directly. Cancellation, rescheduling, and missed-appointment terms for training services are stated in the applicable service agreement.

7. Payments

Payments made through the Site or through links we provide are processed by third-party payment providers under their own terms. Where financing or payment plans are offered, they are provided by third-party financing companies under their own terms. Deposits, refunds, payment schedules, and related obligations for training services are governed by the applicable service agreement.

8. Intellectual property

The Site and its contents, including text, photographs, videos, graphics, logos, training materials, guides, downloadable resources, and course materials, are owned by or licensed to Clark's Canine Training and are protected by copyright, trademark, and other laws.

You may view, download, and print Site content for your own personal, noncommercial use, provided you keep all copyright and other notices intact. You may not copy, reproduce, republish, distribute, sell, license, or otherwise commercially exploit Site content, or use it to create derivative works, without our prior written permission. Training materials provided to clients are for that client's use with their own dog unless we agree otherwise in writing.

9. Acceptable use of the Site

You agree not to:

• Attempt to gain unauthorized access to the Site, its hosting infrastructure, or any related systems or data.
• Introduce malware or other harmful code, or interfere with the Site's operation or security.
• Use automated tools to scrape, harvest, or download Site content or personal information except as permitted by applicable law and our robots.txt file.
• Use the Site or its materials for any unlawful purpose or in a way that infringes the rights of others.
• Submit false, misleading, or abusive information through Site forms or messages.

10. Third-party links and services

The Site links to and integrates with third-party websites and services, including our consultation form, scheduling and messaging tools, payment and financing providers, Google Business Profile and reviews, social media pages, and the organizations and directories that list us. These are independent of us. We are not responsible for their content, availability, terms, or privacy practices, and a link does not imply endorsement.

11. Site disclaimer

We work to keep the Site accurate, current, and available, but we provide it on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current at any given time. Information on the Site is general in nature and is not a substitute for an in-person evaluation of your dog.

12. Limitation of liability for Site use

This section applies to the Site itself, not to training services, which are addressed in the applicable service agreement. To the fullest extent permitted by Mississippi law, Clark's Canine Training will not be liable for indirect, incidental, consequential, or special damages arising from your use of, or inability to use, the Site or its content, and our total liability for any claim arising from the Site will not exceed one hundred dollars (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification for misuse of the Site

If you misuse the Site in violation of Section 9 or use Site content in violation of Section 8, you agree to indemnify Clark's Canine Training against third-party claims, losses, and reasonable expenses, including attorneys' fees, that result from that misuse.

14. Governing law and venue

These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Mississippi, and you consent to their jurisdiction. Disputes relating to training services are governed by the dispute provisions of the applicable service agreement.

15. Changes to these Terms

We may update these Terms from time to time. The Last Updated date at the top of the page shows the current version. Changes take effect when posted, and your continued use of the Site after a change means you accept the updated Terms.
